Transactional Attorney / Manager Field Services ( Network Real Estate) The candidate will provide leadership and management of a fi! rm internal workforce consisting of 11 total headcount to include a supplemental workforce consisting of 25 full time equivalents (FTEs). Provide support in the acquisition of easements, permits, leases, public and private right-of-way and railroad crossing permits for the placement of telecommunications equipment in support of firm s network. Direct management of annual acquisition related spend impacting engineering capital construction projects. Management of over 100,000 existing property interests, including challenges, modifications and payments associated with these rights. Accountability to Director, Construction Services and stakeholders for Network Real Estate s performance, including costs, corporate, departmental and individual objectives, monitoring weekly and monthly reports, project schedules, and customer target dates and management of data records for extensive assets. Lead team with legal knowledge of the principles of easement acquisition, trespass law, e! minent domain, real property law, appraisal, title abstraction! , environmental issues, engineering and state and local regulations. Review language of existing and draft easements, permits, leases and other contracts to clarify the scope of rights to place facilities; clearance rights; expansion rights; payment terms; insurance and legal indemnities; notice requirements; renewal rights, etc. Review economic evaluations to support real property business decisions on contract negotiations concerning price, terms and conditions. Review commercial and residential sale comparable and property tax values, and prepare analyses to determine best of alternative pricing scenarios for the acquisition or renewal of sites. Negotiate with property owners, attorneys, businesses, and government entities, railroads, among others, for the acquisition of new or renewing contracts and engaging in house and outside counsel to settle or litigate complex real estate trespass claims. Review various documents, including releases, subordinations, easements, lea! ses, access agreements, railroad licenses, DOT permits, relocation agreements, title issues, etc. Responsibility for creation and management of expense budgets, accountability in payments for activities impacting network capital and expense transactions through firm s systems.
The candidate should have a Law Degree. Should have substantial real estate experience/practice in the acquisition and management of property rights for the placement of telecommunications facilities in multi-jurisdictions. Also 5+ years of real estate law experience specializing in contract drafting, negotiations, easement, regulatory and environmental law, preferably in both private practice and as an in-house lawyer preferred. Experience in a technically oriented business is highly preferred. Experience in a telecommunications business will be a plus. Strong personal computer and Microsoft application software; Access, Word, Outlook, Power Point, Project, Visio, and Word preferred. Excelle! nt writing, drafting and verbal communications skills needed.
